Pelyr Data Licence 1.1

This is a human-readable summary of — and not a substitute for — the licence. It has no legal force of its own. The binding text is below.

You are free to

  • Use it commercially. Build products on this data and charge for them.
  • Analyse it. Forecasts, statistics, reports, alerts, models — and sell those.
  • Show it. On your map, in your interface, in the documents you export.
  • Keep it. What you have received stays yours to use, indefinitely.

Under these conditions

  • Credit us. “AIS data from Pelyr (pelyr.com), Pelyr Data Licence 1.1”, visible wherever your users see the data.
  • Your product only. The data works inside what you offer. It is not itself what you offer.

You may not

  • Pass on the raw data — not as a file, not as a feed, not through an API. Not for money, and not for free.
  • Relay the Service.
  • Turn your product into a data tap. No bulk or systematic extraction, not even through your own interface, and no export or download that hands your users the positions as data.
  • Mine our public map. No systematic extraction from pelyr.com, and no un-masking of the pseudonymous ids it shows.
  • Track people. Not for surveillance, harassment or the tracking of individuals.

0. What this licence covers

This licence governs AIS data made available by the Licensor (“Pelyr”, “we”, “us”), specifically:

  1. every data frame delivered through Pelyr Stream, and every group of fields in a response of the Pelyr HTTPS API, whose license field resolves to the entry that names this licence — against the sources[] array in the welcome frame of your connection, or against the array served by GET /v1/sources; and
  2. any other AIS data that we obtain directly, as distinct from data we obtain from third-party feeds, and that we make available by any means — including through the public map on pelyr.com and our other public interfaces — unless it is expressly made available under a different licence.

Data that resolves to a different entry in sources[] is not covered by this licence and remains governed by the licence that entry names.

Where this licence refers to Pelyr Stream and the Pelyr HTTPS API together, it calls them the Service. The Pelyr API Terms govern access to it.

The data covered by this licence is referred to as the Licensed Data.

1. Definitions

  • You — the natural or legal person exercising the rights granted by this licence. Your has the corresponding meaning.
  • Your Product — a product or service that You provide under Your own name and Your own responsibility.
  • Derived Result — any output produced from the Licensed Data by analysis, aggregation, modelling, enrichment or presentation, which does not itself contain the Licensed Data or a substantial part of it.
  • End User — a person who uses Your Product without themselves obtaining access to the Licensed Data.
  • Processor — a person who handles the Licensed Data solely on Your instructions and solely for Your Product, such as a hosting provider or a contracted developer.
  • Database Right — the sui generis right of the maker of a database under §§ 76c et seq. of the Austrian Copyright Act (Urheberrechtsgesetz) and the corresponding provisions of Directive 96/9/EC and its national implementations.

2. Grant of rights

2.1 Subject to Your compliance with section 3, we grant You a worldwide, non-exclusive, royalty-free and perpetual licence, subject to section 7, to:

  1. access, store, reproduce and process the Licensed Data;
  2. create Derived Results from it;
  3. display the Licensed Data and Derived Results within Your Product; and
  4. make Derived Results available to third parties, including commercially.

2.2 Commercial use is expressly permitted. You may charge for Your Product and for Derived Results.

2.3 This licence is not transferable and not sublicensable. Section 4 governs who other than You may handle the Licensed Data. Where You are merged into another company, or split, and Your rights pass by universal succession, the successor enters into these same conditions in Your place; the licence does not thereby extend to any other company in the successor’s group.

2.4 The rights granted in respect of Licensed Data You have already received are perpetual. They survive the end of Your access to the Service and the end of any agreement between You and us. Section 7 is the only exception.

2.5 This licence rests on two independent bases: as a licence under the Database Right, and as a contractual undertaking between You and us. If either basis is unavailable or unenforceable in a given case or jurisdiction, the other continues to apply on its own.

3. Conditions

3.1 Attribution

Wherever the Licensed Data or a Derived Result is visible to End Users — in the interface, on the map, in a document exported from Your Product — You must display:

The notice must be reasonably prominent and reasonably legible in the medium concerned. Placing it only in source code, in a configuration file or in internal documentation does not satisfy this condition.

Where the medium makes a visible notice impracticable — an SMS alert, a voice response, a machine-to-machine interface — a notice in the accompanying documentation or at a stated URL is sufficient for that medium.

Where a Derived Result is an aggregate from which no individual position report can be identified, attribution may be given once for the publication as a whole rather than at each figure.

Where You obtain data through the Pelyr HTTPS API, a single response routinely carries data from more than one source. Attribution is then collective: You must display the notice for every source represented in what You show, this one among them.

3.2 Your product only

The Licensed Data may be used only in and for Your Product.

The test is this: the Licensed Data flows into what You offer. It is not itself what You offer. Where a recipient is receiving, or paying for, the data rather than something You have made from it, this licence does not permit it.

3.3 No redistribution of the data

You must not make the Licensed Data, or a substantial part of it, available to any third party — whether for payment or free of charge — and in particular not:

  1. as a file, dump or dataset in any format;
  2. through an interface that returns position reports;
  3. as part of a database, data product or data collection;
  4. by way of sale, licence, sub-licence, publication, or contribution to an open data collection.

3.4 No relay of the Service

You must not forward, re-serve, proxy or mirror the Service, in whole or in part — neither the frames of Pelyr Stream nor the responses of the Pelyr HTTPS API — and must not allow any third party to receive it through Your access.

3.5 No systematic extraction

You must not carry out, and must not permit, the repeated and systematic extraction of insubstantial parts of the Licensed Data in a manner that amounts, cumulatively, to the extraction of a substantial part.

This applies to extraction through Your Product’s own interface exactly as it applies to any other route. Where Your Product exposes the Licensed Data to End Users, You must take reasonable measures to prevent extraction of that kind through that exposure.

3.6 Model training

You may use the Licensed Data to train, validate or evaluate statistical or machine-learning models.

The resulting model must not be capable of reproducing individual position reports from the Licensed Data on demand, and must not be distributed as a means of making the Licensed Data available. A model that does either is treated as the Licensed Data itself under section 3.3.

3.7 No surveillance of individuals

You must not use the Licensed Data for the surveillance, harassment or tracking of individuals.

3.8 The public map

The map on pelyr.com is a feature of our website. It is not an access route to the Licensed Data, and using it as one is not permitted: You must not extract data from it systematically, whether through the map itself or through the interfaces behind it.

Its anonymous view identifies vessels by a pseudonymous identifier that carries no MMSI and no vessel name, and that is replaced at regular intervals. You must not attempt to resolve that identifier to a vessel, and must not link it across a change, whether by correlating positions or by any other means.

4. Who other than You may handle the data

4.1 End Users may see the Licensed Data and Derived Results within Your Product. They acquire no rights in the Licensed Data. Displaying the data to them is not redistribution under section 3.3.

4.2 Processors may handle the Licensed Data on Your behalf, provided they do so solely for Your Product, solely on Your instructions, and under obligations at least as protective as those in this licence. A Processor acquires no rights in the Licensed Data. You remain fully responsible for their compliance.

4.3 No one else. This licence does not extend to companies affiliated with You, whether parent, subsidiary or sister companies. Each requires its own licence.

5. Examples

Illustrations, not an exhaustive list. Where a case is not listed, section 3.2 decides it.

An alert when a vessel enters a defined area. Forwarding Pelyr Stream to a partner.
Statistics, indicators and dashboards derived from the data. Selling access to a database that contains the Licensed Data.
Storing the data and analysing it over time. A download or export function that hands the underlying position reports to End Users as data.
Looking at the public map on pelyr.com. Harvesting the public map, or the interfaces behind it, as a data source.
Showing an End User how old a position report is. Resolving the map’s pseudonymous identifier to a vessel, or linking it across a change.

6. No warranty, no liability, and a safety restriction

6.1 The Licensed Data is provided as is and as available. We give no warranty of any kind. It may be incomplete, delayed, inaccurate, spoofed or entirely absent for any vessel or area at any time.

6.2 Not for navigation. Not a safety system. The Licensed Data must not be used as a basis for navigation, collision avoidance, search and rescue, or any other decision affecting the safety of life, health, property or the environment. It is not a substitute for the equipment and procedures required under SOLAS, COLREG or any other applicable maritime regulation, and it is not a certified or approved navigational aid. You are responsible for ensuring that Your Product, and everyone to whom You make Derived Results available, observes this restriction.

6.3 To the extent permitted by applicable law:

  • We are liable without limitation for damages arising from injury to life, body or health, and for damages caused intentionally or by gross negligence.
  • We are not liable for slight negligence, except where an essential contractual obligation is breached; in that case liability is limited to the damage typically foreseeable for data provided without charge.
  • We are not liable for loss of profit, loss of data, business interruption, or any damage arising from the unavailability, incompleteness, delay or inaccuracy of the Licensed Data, nor for any consequence of use contrary to section 6.2.

Nothing in this licence limits liability that cannot be limited by law, including under the Austrian Product Liability Act (Produkthaftungsgesetz).

7. Breach

7.1 If You breach any condition in section 3, the rights granted in section 2 terminate automatically.

7.2 Termination is permanent. We may reinstate the rights at our discretion, and only in writing; nothing obliges us to, and curing the breach does not reinstate them by itself.

7.3 Once the rights have terminated You must cease all use of the Licensed Data and delete such copies of it as are within Your control. Derived Results already created that contain neither the Licensed Data nor a substantial part of it are unaffected.

7.4 Nothing in this section limits any other right or remedy available to us, including termination of Your access under the Pelyr API Terms.

8. Versions

8.1 We may publish new versions of this licence. Each carries its own version number.

8.2 Licensed Data remains subject to the version under which it was made available. Where the sources[] entry resolved for a data frame or an HTTPS response names a licence identifier that carries a version number, that identifier determines the version; otherwise the version published on this page at the time the data was made available applies. A new version applies only to data made available after its publication.

9. General

9.1 No trade mark rights. This licence grants no right to use “Pelyr” or any Pelyr name or logo, other than as required by the attribution in section 3.1.

9.2 No endorsement. Attribution does not imply that we endorse You or Your Product, and You must not state or imply that we do.

9.3 No other rights. Rights not expressly granted are reserved. This licence does not affect rights You have under mandatory law, including exceptions and limitations to the Database Right.

9.4 Data under other licences. Data that resolves to a different entry in sources[] — for example one licensed under CC-BY-4.0 or NLOD — is governed by that licence and not by this one. Where Your Product combines them, each licence applies to its own part.

9.5 Language. The English text is the authoritative version.

9.6 Governing law and jurisdiction. This licence is governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If You are a consumer within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz), this choice of law does not deprive You of the protection of mandatory provisions of the law of Your country of residence, and You may bring proceedings in the courts of Your place of residence. For all other users, the courts competent for St. Veit an der Glan, Austria shall have exclusive jurisdiction.

9.7 Severability. If any provision of this licence is or becomes invalid, the validity of the remaining provisions is unaffected.
